1. Accepting the terms

By using Harvestead or our website, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the service.

2. Eligibility

You must be at least 13 years old to use Harvestead. Paid plans require a valid payment method. If you are using Harvestead on behalf of a farm or business, you represent that you have authority to bind that organization.

3. Your account

You are responsible for keeping your login credentials secure and for all activity under your account. Choose a respectful username; usernames that impersonate others, contain offensive language, or infringe on our brand may be changed or removed.

4. Community rules

The Grove is a place to learn, share, and connect. To keep it safe, you agree not to:

• Post illegal, harmful, hateful, or explicit content.
• Harass, threaten, or impersonate other members.
• Post spam, scams, or repeated off-topic promotions.
• Share medical, legal, or tax advice as if you are a licensed professional.
• Upload content you do not have the right to share.

We may remove content or suspend accounts that violate these rules. Major violations may result in a permanent ban.

5. Content you share

You keep ownership of your photos, posts, and garden data. By sharing them in The Grove, you grant us a limited license to display, store, and moderate that content as needed to run the community.

6. Subscriptions and billing

Paid plans are billed on a recurring basis until canceled. You can cancel anytime through the billing portal. Refund requests are handled on a case-by-case basis within 7 days of a charge. We may change pricing with advance notice to active subscribers.

7. Safety, gardening guidance, and release

Everything Harvestead provides is a guide, not a professional determination. Harvestead is a learning and planning tool, not a substitute for professional agricultural, veterinary, food-safety, medical, legal, or financial advice. Always follow local regulations, food-safety guidelines, product labels, and common sense when growing, preserving, and selling food. Use plant and pest identification features, Harvestead Garden Guardian readings and suggestions, tools, tips, education, and any purchases or recommendations at your own discretion and risk, and verify critical decisions locally.

Plant identification and edibility. Identification from a photo or description can never establish that a plant, berry, seed, mushroom, or foraged find is safe to eat, touch, or feed to a person or an animal. Many edible plants have toxic look-alikes, and parts of otherwise edible plants can be poisonous. Treat anything you have not positively identified in person, with a qualified local expert, as inedible, and keep it away from children, pets, and livestock. Harvestead does not identify mushrooms or fungi for eating, and never confirms edibility.

Toxicity, chemicals, and equipment. Where we can, we flag plants and materials that are toxic or irritating to people, children, pets, or livestock, but our flags may be incomplete or wrong and their absence is not a statement of safety. You are responsible for reading and following every product label, including rates, protective equipment, re-entry and pre-harvest intervals, drift, and disposal, and for complying with pesticide, water, and soil rules where you live.

Emergencies. Harvestead does not provide medical or veterinary care. If a person or animal may have eaten, touched, or inhaled a plant or product, or shows any symptoms, contact Poison Control (1-800-222-1222 in the United States), emergency services, a doctor, or a veterinarian immediately rather than relying on anything here.

When we say we are unsure, take it seriously. Automated features state their confidence and will tell you when a reading is uncertain. When they do, stop and confirm locally before acting. Do not treat a low-confidence reading as a diagnosis, and do not escalate treatments beyond what a label allows.

By using Harvestead, you agree to use the platform, its content, tools, garden grow coach suggestions, and any member-contributed or automated suggestions entirely at your own risk. To the fullest extent permitted by law, you agree not to sue or hold Harvestead, its owners, staff, or contributors liable for any claims, damages, or outcomes arising from your use of the service or from anything shared by other users or generated by automated features.

8. Termination

You can stop using Harvestead at any time. We may suspend or terminate access for violations of these terms, repeated abuse, or to protect the service or other users.

9. Copyright and DMCA

Members are responsible for the photos, posts, and listings they upload and must have the rights to them. If you believe material on Harvestead infringes your copyright, send a notice to our designated agent as described in our Copyright & DMCA Policy. We remove infringing material promptly and terminate repeat infringers.

10. Disclaimers, liability, and governing law

Use at your own risk. You expressly acknowledge and agree that your use of Harvestead and every feature, tool, recommendation, calculation, identification, community post, course, ebook, email, notification, and piece of content accessed through the platform is at your sole risk. Harvestead is an educational and planning aid, not a professional service. You are solely responsible for any decision, action, planting, treatment, purchase, sale, preservation, or practice you undertake based on anything you see, read, or receive from Harvestead.

Assumption of risk and release. To the fullest extent permitted by law, you assume all risks associated with using Harvestead and waive, release, and hold harmless reapandsowpa, LLC, its owners, members, managers, employees, agents, contractors, contributors, partners, and licensors from any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your access to or use of the platform, any content or output generated by or obtained through the platform, any interaction with other users, any crop loss, property damage, personal injury, illness, allergic reaction, foodborne illness, financial loss, or any other outcome, whether or not Harvestead was advised of the possibility of such damages.

Harvestead provides educational growing information as guidance only. It is not agricultural, veterinary, food-safety, medical, legal, or financial advice, and no feature of the platform creates a professional relationship or certifies that any plant, produce, material, or practice is safe. Growing outcomes vary with weather, soil, and practice, and automated suggestions can be wrong. Verify anything that affects your health, your food safety, or your income with local authorities and professionals.

To the maximum extent permitted by law, the service is provided “as is” without warranties of any kind, and reapandsowpa, LLC is not liable for indirect, incidental, or consequential damages, or for lost crops, profits, or data. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.

These terms are governed by the laws of the United States and the state in which Harvestead is organized, without regard to conflict-of-law rules.

11. Dispute resolution, arbitration, and agreement not to sue

Agreement to arbitrate. By using Harvestead, you and reapandsowpa, LLC agree that any dispute, claim, or controversy between us: whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of when the claim arose: will be resolved exclusively through final and binding individual arbitration, except as described below. This includes disputes about the validity or enforceability of this arbitration agreement.

Agreement not to sue. To the fullest extent permitted by law, you agree not to sue reapandsowpa, LLC, its owners, members, employees, agents, contractors, or contributors in court over any dispute covered by this section. You waive any right to a jury trial and any right to participate in a class action, collective action, representative action, or private attorney general action against us. Disputes may only be brought on an individual basis; consolidated or joined claims are not permitted.

Arbitration rules and process. Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, except as modified here. The arbitrator has the same authority to award relief that a court would have, including damages, injunctive relief, and attorneys’ fees, but only on an individual basis. The arbitrator’s decision will be final and binding, and judgment on it may be entered in any court of competent jurisdiction.

Exceptions. Either party may seek relief in small claims court for disputes within the court’s jurisdiction. Either party may also seek injunctive or other equitable relief in court to prevent intellectual-property infringement or the misuse, abuse, or unauthorized access of the service.

12. Changes to these terms

We may update these terms from time to time. Continued use of Harvestead after changes means you accept the updated terms. Material changes will be announced in the app or via email when practical.
